Traffic School in Virginia: Using a Clinic in Court
This page is for a Virginia driver with a court date who wants to know whether a class can help. You cannot pick a traffic school to mask or dismiss a ticket here. What exists is the 8 hour driver improvement clinic, and under Code of Virginia 46.2-505 a judge may require it instead of, or in addition to, the usual penalty. The judge also decides whether it earns safe driving points. For CDL holders, no court may reduce or dismiss a charge because of a clinic.

Step by step
Study the summons
Find the court, the date and whether the charge is prepayable. If you want the judge to weigh a clinic, do not prepay, because that is a guilty finding.
Phone the clerk ahead of time
Ask whether the court or judge considers clinics, whether it should be finished before the hearing, and whether online clinics count. Habits vary from court to court.
Sign up with a licensed clinic
Find an in-person clinic or a licensed online provider through DMV's search, and tell the provider it is court related so the attendance is coded properly.
Take proof to court
If the court wants the clinic done beforehand, bring the certificate. If the court orders it, bring the court document that says whether you get safe driving points.
Report back as ordered
Code of Virginia 46.2-505 requires a driver sent to a clinic by a court to tell the court whether it was completed. Skipping it can be treated as contempt.
Before you search for a course: what exists here
Many states have a program where you take a class and the ticket disappears. Virginia does not. No statute gives you that right. DMV's equivalent is the driver improvement clinic, which people attend for safe driving points, for an insurance reduction, because DMV ordered it, or because a court did.
Judges get this power from 46.2-505, and it applies in every kind of court that hears traffic cases: general district, juvenile, circuit and federal. After finding you guilty, the judge may assign a clinic or a mature driver crash prevention course, either swapping it for the ordinary penalty or adding it.
A week or two before court: talking to the clerk
The clerk's office of the court on your summons is the place to start; vacourts.gov lists contact details for general district courts. Ask what that court's judges usually expect. Some want the clinic already finished at the hearing, and some refuse computer-based courses.
Then show up on your date. If you have already prepaid, there is nothing left for the judge to consider: prepayment is a guilty finding and closes the case. Bring a copy of your driving record, because a clean history can matter.
Here is a typical sequence. You are stopped for 12 over on a Monday. You call the clerk on Thursday, learn the judge likes to see a certificate at the hearing and accepts online clinics, finish one over the weekend, and walk into court three weeks later with the certificate and your record.
If you hold a CDL or face a serious charge
Under 46.2-505, no court may reduce, dismiss or defer a conviction because of a clinic when the offense happened in a commercial motor vehicle, or when a CDL holder is charged in a personal vehicle. If you drive commercially, assume every ticket will stay on your record.
Big charges change the picture. Going above 85, or 20 or more over the posted limit, is reckless driving in Virginia: six points and a DMV entry that lasts 11 years. Expect a judge may still add a clinic, but do not expect it to soften the charge. For reckless driving or DUI, get advice from a Virginia lawyer.
Signing up: format, price and paperwork
You will pay $100 or less. Classroom or online both work if the provider holds a DMV license, and classroom students take the closing test on site. Clinics report completion to DMV, and in-person clinics must do so within 24 hours.
Have government-issued photo ID with you. If the court ordered the clinic and said you should receive safe driving points, give the clinic that court document, or DMV credits none.
After the clinic: how often it can count
Code of Virginia 46.2-498 allows the benefit of a clinic, whether safe driving points or an insurance reduction, only once in two years from completion. You can take a second clinic one year after the first to collect whichever benefit you skipped the first time, such as insurance after points.
A clinic DMV orders because of your point total does not reset that clock in your favor, so look at your record before signing up on your own.
If you decide to pay or to fight
Paying is easy once the case shows up online, which typically takes up to ten business days. Search the Virginia Judicial System site under your name spelled the way the officer spelled it, expect a 4 percent surcharge on cards, and save or print the receipt page.
Fighting it means entering a not guilty plea in court. If general district court finds against you, circuit court will hear an appeal filed inside ten days (16.1-132). And a reassurance if money is tight: the old law suspending licenses over unpaid fines, 46.2-395, was repealed in 2020, though the debt can still be sent to collectors.
For older drivers and insurance shoppers
Drivers 55 and older who voluntarily finish a DMV-approved mature driver crash prevention course must receive an appropriate premium reduction for three years. A course ordered by a court does not count under Code of Virginia 38.2-2217.
Drivers 54 and younger may get a two year reduction after a voluntary clinic, but insurers are not obliged to offer it, and a clinic coded for insurance earns no safe driving points.
Virginia defensive driving: common questions
Can I take traffic school to get a Virginia ticket dismissed?
There is no right to that. A judge may require or accept a driver improvement clinic under 46.2-505, so ask the clerk before your date.
Should I finish the clinic before court?
Many drivers do, but courts differ. Ask the clerk whether the judge wants it done beforehand and whether online clinics count.
Will the court accept an online clinic?
DMV accepts licensed online providers, but some courts do not take computer-based courses. Check first.
I have a CDL. Can a clinic help?
No court may reduce, dismiss or defer a CDL holder's conviction because of a clinic, even for a ticket in a personal car.
How long do I have to appeal?
Ten days from a general district court conviction, under 16.1-132.
What if I skip a clinic the court ordered?
The court can treat it as contempt, and you are required to report whether you completed it.
Does prepaying close my case?
Yes. Prepayment is a guilty finding, so a judge has no chance to consider a clinic or a lesser charge.
