Traffic School in Idaho: What You Can Do Instead
This page is for Idaho drivers who were just cited and assumed traffic school would make it disappear. It will not: Idaho has no course that dismisses or hides a ticket, and judges are not allowed to withhold judgment on infractions. What you can choose between are two partial fixes. If a city officer stopped you and your city runs a traffic safety education program, say yes on the spot and complete it inside 45 days, and that ticket never adds points. Otherwise, a 6 hour defensive driving class from an approved provider subtracts 3 points from your running total, an option you get once in any three years.
- Ticket dismissal by course
- Not offered in Idaho
- City program timing
- Choose at the stop, finish within 45 days
- City program fee
- Up to $25, on top of the fine
- Speeding 1 to 15 over
- $90 total (schedule effective July 1, 2025)
- Speeding 16+ over
- $155 total
- How often
- One point break every 3 years
- CDL holders
- Shut out of the city program
Step by step
Read the ticket carefully
The Idaho Uniform Citation shows the court, the violation and the appearance date. Check whether it is an infraction with a fixed penalty or a misdemeanor, which means going to court and possibly harsher penalties.
Speak up about the city program
If a city officer is citing you for a moving infraction with no crash, and the city has a program under Idaho Code 50-336, ask for it before the officer finishes writing. The officer marks your choice and gives you details.
Admit or deny
Paying is how you admit it; get the money to the court by the date printed on the ticket, online, by post or in person. Fighting it means visiting the clerk on or before that same date to say not guilty, which gets you a trial date.
Pay the fine regardless
Courses never cancel what you owe the court. The clerk still collects the penalty and costs, and the city separately collects its program fee, which tops out at $25.
Finish on time and keep proof
You get 45 days from the ticket date to finish a city program; the city then has 15 days to tell the court. Defensive driving providers issue a certificate, which you should file somewhere safe.
Check your record later
Order your Idaho record a few weeks on to confirm the ticket shows no points or your total fell by 3. If not, contact ITD with your certificate.
First, why there is no ticket-dismissal school
Elsewhere, finishing traffic school can persuade a judge to defer or drop the case. Idaho shut that door twice. Idaho Infraction Rule 9 tells courts they may not withhold judgment on an infraction or knock anything off its fixed penalty and costs. And ITD's points rule, IDAPA 39.02.71, says plainly that taking a defensive driving class or a city safety program will not take a conviction off your record.
That changes the question you should ask. Not whether it erases the ticket, but whether it keeps points off or brings your total down. Points are what lead to suspension, and insurers tend to look at them.
At the stop: the city program
Whether a program exists at all is up to each city, which adopts one by ordinance under Idaho Code 50-336. It is meant for a driver whom a city officer tickets for a moving infraction where nobody crashed. You opt in while the officer is writing; showing up at the courthouse a week later and asking is too late.
Complete it in 45 days or less and two good things happen: the ticket carries zero points, and insurers may not rate you as if you had a moving violation. Two things do not change: the conviction is still recorded, and the clerk still expects the fine and costs. The city's own fee is capped at $25.
- County deputy and Idaho State Police tickets do not qualify; only city officers' tickets do
- Not available if you used the program or a 3 point class in the past three years
- Closed to anyone with a CDL, and to anyone ticketed while behind the wheel of a commercial vehicle
- Check with your city police or city clerk that a program exists before counting on it
Within the deadline: paying
Amounts are not negotiable. The Idaho Supreme Court publishes an Infraction Penalty Schedule combining a fixed penalty with court costs, and the version in force since July 1, 2025 sets these totals. Ordinary speeding (up to 15 over) and most other moving infractions: $90. Sixteen or more over: $155. Speeding through a construction zone: $106.50; through a school zone: $156.50. Handheld phone tickets under Idaho Code 49-1401A climb with repeats: $131.50 the first time, $206.50 for a second inside three years, $356.50 for a third.
Remember that paying counts as pleading guilty. Mailed payments must reach the court by the appearance date; you can also pay in person at the clerk's counter. Lost the ticket? The Supreme Court's website has a payment link and a statewide search covering magistrate and district cases. Cash, checks and money orders are accepted, cards where the court takes them, and if the full amount is out of reach, ask the clerk for a deferred payment agreement.
Worked example: you were clocked at 12 over by a county deputy. The city program is not an option, so you pay $90 and, if your points are piling up, take the 3 point class afterward.
Within the deadline: contesting
Contesting starts at the clerk's window. Go there by the appearance date and enter a denial, or request a continuance if you need time before answering. You will be handed, or mailed, a notice with your trial date. The burden at trial is on the state, and it is a high one: beyond a reasonable doubt. Fall short, and you walk away with no conviction, no fine and no points.
Do not simply skip either date. Idaho Infraction Rule 8 has the judge enter a default against an absent driver with no further warning, and a default is a conviction, points included. Because every county's magistrate court runs its own infraction calendar, the details (including online options) vary, so phone the clerk listed on the citation.
If you do not pay
Unpaid tickets used to cost Idahoans their licenses. Since July 1, 2018, Idaho Code 49-328 forbids that, and drivers who had been suspended only for nonpayment before then were to get their licenses back at no charge. In 2026 lawmakers floated House Bill 791 to bring suspensions back once a moving infraction penalty was a month or more overdue; it was referred to committee in March 2026, and the bill's status page records no later action.
You still owe the money, though. Courts may chase it through collections or any other legal route, and they will take a late payment whenever you send it. Meanwhile a default lands on your ITD record with its points just like any conviction. None of this applies to misdemeanors, where missing court has consequences of its own.
If you hold a CDL
Commercial drivers play by federal rules. A state is forbidden by 49 CFR 384.226 from hiding or diverting any conviction of a CDL holder, whatever vehicle they were in, and that is the reason Idaho Code 50-336 keeps them out of city programs. Separately, 49 CFR 383.31 gives a CDL driver 30 days to tell the employer, in writing, about any traffic conviction other than parking, personal car included.
The 3 point class is still open to you as a CDL holder, and it will lower your Idaho count. It does nothing to what the federal commercial record shows. When your livelihood rides on that license, get legal advice before you plead guilty to anything serious.
Idaho defensive driving: common questions
Is there traffic school for an Idaho speeding ticket?
Not one that dismisses it. If a city officer wrote the ticket and your city has a traffic safety education program, finishing it within 45 days keeps points off, but the fine and court costs still apply.
How much is an Idaho speeding ticket?
Up to 15 over costs $90 in total and 16 or more over costs $155. Zones cost more: $106.50 in construction, $156.50 near a school. Those figures come from the schedule that began July 1, 2025.
Could a magistrate agree to traffic school instead of a conviction?
No. Idaho Infraction Rule 9 bars withholding judgment or suspending any part of an infraction penalty, and the city program has to be chosen when the ticket is written.
Will not paying get my license suspended?
Idaho no longer suspends for an unpaid infraction. Expect a judgment and collection efforts instead, and if you skipped your date, a default conviction that brings points.
Can I pay online?
Many Idaho courts take online payment through the link on the Idaho Supreme Court's site. Mail and the clerk's office in the citation's county also work.
Can a CDL holder use any of this?
Only partly. City programs are off limits, while the 3 point class is allowed, but whatever conviction you have will still show on the federal commercial record.
How much is a handheld phone ticket?
It escalates: $131.50 for the first, $206.50 if you are caught again inside three years, and $356.50 for a third, per the schedule that took effect July 1, 2025.
