How Traffic School Works in Utah: Deferred Traffic Prosecution

This page is for a Utah driver who wants to know whether traffic school can keep a ticket off the record. In Utah, that program is Deferred Traffic Prosecution (DTP). If you are 21 or older and the ticket qualifies, you register within 21 days of the citation, plead no contest, and pay the fine plus $5, adding $40 for online traffic school if the court assigns it. Stay ticket free for a year and the case is dismissed, with no points sent to your record.

Step by step

  1. Hold off on paying

A payment is a guilty plea. Once you pay, the conviction and points head to DLD and DTP is gone.

  2. Give it five days, then search MyCase

The courts note that a citation can take a few days to show up. Set up a MyCase account, find your case, and it will tell you whether you qualify.

  3. Register and plead no contest before day 21

Enroll through MyCase, enter the no contest plea and pay the fine with the $5 registration fee, now or within 14 days.

  4. Complete traffic school if it is assigned

Some records lead the court to require online traffic school. It costs $40, and you have 28 days to finish.

  5. Keep the next 12 months clean

No new tickets during the deferral year means the plea is withdrawn and the case dismissed.

  6. Confirm it on your record

A few weeks after the year ends, order your driving record from DLD and make sure no conviction or points were posted.

Before you sign up: the eligibility rules

Utah Code 77-2-4.2 lays them out. You have to be at least 21, hold a valid Utah license that is not a CDL, and not already be serving a deferral period for another ticket. Any traffic violation or infraction conviction in the last 24 months rules you out.

The citation matters too. It has to be a moving violation under Title 41, Chapter 6a, and it cannot be connected to a crash. The traffic school version can take some stops with two violations, or speeding 20 to 30 over, provided your record is otherwise clean.

  • Out: 100 mph or faster
  • Out: three or more moving violations from one stop
  • Out: any stop that includes a misdemeanor or felony charge

What you pay, and what you give up

DTP is not a discount. You pay the full fine as if you were just paying the ticket, plus $5 to register and $40 if the court assigns online traffic school. If the deal falls apart, you do not get that money back.

You also waive your chance to fight the ticket. A new citation during the year means, according to the courts, that your no contest plea goes onto your driving record automatically and you lose the option of returning to court on the original charge.

If MyCase says no: ask about a plea in abeyance

When DTP is off the table, ask the court about a plea in abeyance. The court sets your guilty or no contest plea aside for up to a year, and if you meet the conditions it may set, such as traffic school or a clean record, the charge is dismissed.

Whether to offer one, and on what terms, is each court's decision. Utah Code 77-2-4.2 limits the fee to $25 above the scheduled fine. The clerk of the court on your citation has the forms.

If your court is in the pilot: Traffic ODR

A handful of justice courts offer Traffic Online Dispute Resolution, a free, voluntary process where you exchange messages with the prosecutor to reach an agreement. Possible outcomes include a smaller fine, a payment plan, community service or a plea in abeyance, and a judge has to approve the result.

Sign-up has the same 21 day window. You cannot use it with a lawyer, with a commercial license, or on a case already in DTP. As of October 2026 the courts name the Carbon County and Orem City justice courts, and also mention West Jordan, so check with your own court.

If you would rather pay or fight

Many courts take payment through the Utah Courts ePayments site using the citation or case number, or by mail, and some run their own payment pages. Most traffic tickets are infractions, meaning no jail and a fine no higher than $750.

Fighting usually means appearing, pleading not guilty, and then either reaching a deal with the prosecutor or going to trial, where the officer and any witnesses can testify. You can appeal a justice court decision to district court and get an entirely new trial if your notice of appeal is filed within 28 days of judgment.

If something goes wrong: missed dates, lost tickets and CDLs

Let the citation date pass without paying or appearing and the court may issue a warrant and suspend your license. Once the failure to appear is resolved, DLD charges $40 to reinstate. Lost the ticket itself? Contact the agency that issued it, such as the local police or the Utah Highway Patrol office for that area.

A CDL keeps you out of DTP, even for a ticket you got in your own car. That leaves a plea in abeyance, if the court offers one, or contesting the charge. A CDL driver should talk to the court or a lawyer before paying anything.

Utah defensive driving: common questions

Can traffic school dismiss a ticket in Utah?

It can. Utah calls it Deferred Traffic Prosecution: qualify at 21 or over, pay the fine with $5 on top, do the $40 online class if told to, and a clean 12 months ends in dismissal.

What is the deadline?

Three weeks. Give it five days first, though, or MyCase may not show the case yet.

I am 20. Can I still do traffic school?

Not DTP, which starts at 21. Ask the court about a plea in abeyance.

Will DTP keep the ticket away from my insurer?

A completed year leaves nothing on your record: no conviction, no points. Insurers look at that record, though each one follows its own rating rules.

What happens if I get pulled over again during the year?

Your no contest plea goes on your record, the first ticket becomes a conviction, and none of the money is refunded.

How do I appeal a justice court ruling?

Within 28 days, file your notice of appeal at the justice court. District court then tries the whole thing over.

I lost my ticket. What now?

Contact the agency that issued it, such as the local police or the Utah Highway Patrol office for that area, to get the details you need.
