Defensive Driving in Virginia: How the Clinic Really Works
Can reduce points
This page is for a Virginia driver who has heard that a defensive driving course helps after a ticket and wants to know exactly how. Virginia's version is the 8 hour driver improvement clinic. Take it on your own and DMV credits you 5 safe driving points, usable once every 24 months; those points cancel out demerits in DMV's math but leave the conviction in place. A judge can also send you to a clinic and decides whether that one earns points. Drivers 55 and up have a separate mature driver course that insurers must reward.

Step by step
Look at your balance first
Sign in to your DMV account and compare your demerit and safe driving points. That shows whether 5 more safe points would actually move you.
Be clear about why you are going
DMV tags every clinic attendance with a reason: volunteer, insurance, DMV required or court required. The tag decides whether points are credited, so give the clinic the right one at sign-up.
Pick a licensed clinic
DMV's search lists classroom clinics and licensed online providers. If a court sent you, confirm that court will accept an online course before you enroll in one.
Bring photo ID and the court's paper
Every attendee needs government-issued photo ID. If a judge ordered the clinic and said you should get safe driving points, hand that order to the clinic, or DMV will not credit them.
Complete the course and the test
Online, both pieces run through the licensed provider. In a classroom, the final test is taken in person too, and the clinic reports to DMV within 24 hours.
Tell the court you finished, if it sent you
Code of Virginia 46.2-505 requires anyone a court sends to a clinic to report back on completion. Ignoring a court-ordered clinic can be treated as contempt.
First, what a clinic cannot do
No Virginia law lets you trade a course for a dismissed ticket. What 46.2-505 does is give any court hearing a traffic case the power to send a guilty driver to a driver improvement clinic, instead of or on top of the normal penalty. Whether that happens in your case is the judge's call.
If you are hoping for that outcome, phone the clerk at the court printed on your summons before the hearing and ask how its judges treat clinics. One group is shut out entirely: the statute forbids reducing, dismissing or deferring anything because of a clinic for a commercial vehicle offense, or for any CDL holder, even one ticketed in the family car.
Before your court date: pay or appear?
A summons marked prepayable can normally be settled without a court visit, online through the Virginia Judicial System or however that court directs. But paying is a guilty finding, and the demerit points arrive with it. Courts usually load traffic cases into the online system within 10 business days, and paying by card costs an extra 4 percent.
Want a judge to weigh a clinic, consider a lesser charge or hear your side? Then do not prepay. Go on the date shown, and if the general district court convicts you, Code of Virginia 16.1-132 gives you 10 days to appeal to circuit court.
Misplaced the summons? Use the court map on vacourts.gov to find the court for the place you were stopped, or call the agency that wrote the ticket. Since 2020 Virginia no longer suspends licenses just for unpaid court fines and costs, but the debt still goes to collection, so ask the clerk about a payment plan.
The math: how safe driving points offset demerits
Keep a clean, valid Virginia license through a whole calendar year and DMV banks a safe driving point for you; the bank holds five at most. A clinic adds five in one go, but only once in any 24 month period.
These points do not wipe out a conviction. They reduce the number DMV compares against its warning, clinic and suspension levels. DMV credits the yearly point in early April for the year before. Example: you hold 2 safe driving points and get a 4 point speeding ticket. A voluntary clinic tops you up to the cap of 5, leaving your net count at minus 1 instead of plus 2.
Which clinics earn points
It all comes down to the reason code DMV attaches:
- You chose to go: points credited
- DMV told you to go: points credited at 18 and older, none under 18
- A court told you to go: points only with a court document saying so
- You went for an insurance discount: no points
- Clinics for commercial drivers use matching commercial reason codes
If points pile up: DMV's thresholds at 18 and older
Each violation carries 3, 4 or 6 demerit points by severity, and they count for two years from the offense date. Tickets from other states get points as well.
Watch three trigger levels. An advisory letter comes at 8 points in a year or 12 in two. A required clinic, due within 90 days, comes at 12 in a year or 18 in two. A 90 day suspension plus a clinic comes at 18 in a year or 24 in two.
Fine print matters here. Drivers who were 18 or 19 on the date of an offense get sent to a clinic for that conviction whatever their total. A points suspension is followed by half a year of probation; slip up then and you lose the license again for 45, 60 or 90 days (3, 4 or 6 point offense), with 18 months of driver control afterward. One newer escape hatch: under 2025 amendments to Code of Virginia 46.2-506, a driver who hits the suspension level may be offered a speed-limiting device program (Intelligent Speed Assistance) for nine months, plus the clinic, in place of 90 days without a license. That offer comes by letter and expires if you do not respond within 30 days.
If the driver is under 18
Teens get one strike before school: the first point-carrying conviction, or a belt or car seat violation, puts them in a clinic, which has to be completed within three months or the permit or license is suspended until it is.
A teen who signs up voluntarily earns the 5 safe driving points, but a clinic DMV or a court required earns nothing. The second conviction suspends the license for 90 days, and the third revokes it for a year or until 18, whichever is longer.
Signing up: format, cost and extensions
The clinic runs eight hours and may not cost more than $100. You can do it online at any age through a DMV-licensed provider, which handles both the course and the final test, but some courts reject computer-based courses.
Ordered by DMV? Then all eight hours are due inside three months, and missing that window suspends you until you catch up. College students and service members stationed outside Virginia may get an extension if no approved clinic is available where they are.
If you are mainly after an insurance discount
Past 55? Then the insurance rule has teeth. Code of Virginia 38.2-2217 obliges insurers to lower your rate appropriately for three years once you choose to complete a mature driver crash prevention course that DMV has approved. Being sentenced to the course by a judge does not count.
Under 55, it is optional for the insurer, which may offer two years of lower rates after a clinic you took on your own. And a clinic taken for the insurance reason earns no safe driving points, so decide which benefit you want before you register.
Limits worth knowing
A clinic does not shorten how long the conviction stays on your record; DMV keeps convictions for fixed periods, some forever. An insurance-coded clinic earns no points, and a court-assigned clinic does not earn the insurance reduction.
Restricted driving privileges from DMV never extend to commercial vehicles, and CDL holders need a commercial driver improvement clinic built for them.
Virginia defensive driving: common questions
Will a clinic make my Virginia ticket go away?
Not automatically. Under 46.2-505 a judge may order a clinic instead of or in addition to other penalties, so call the court before your date.
How many points does a voluntary clinic add?
Five safe driving points, once every 24 months. Your safe driving balance cannot exceed five.
Can I do the clinic online?
Any age can, using a provider DMV has licensed for online delivery. Court-ordered? Make sure that court takes online completions.
What does a clinic cost?
No more than $100 for the eight hours, per DMV.
How long do demerit points count?
Two years from the offense date. The conviction itself can stay on your record much longer.
At what point total is my license suspended?
At 18 and older, 18 points in 12 months or 24 in 24 months means a 90 day suspension and a required clinic.
Is there a discount for older drivers who take a course?
At 55 and up, yes, and it is mandatory: finish the approved mature driver course voluntarily and your insurer owes you three years of lower rates.
Can a CDL holder use a clinic to get a ticket reduced?
No. Section 46.2-505 bars courts from reducing, dismissing or deferring a CDL holder's conviction because of a clinic.
If I prepay my ticket, have I pleaded guilty?
Yes. Prepayment is a guilty finding and DMV adds the points. Go to court if you want a clinic or lesser charge considered.
Can unpaid fines cost me my license?
Not for fines alone, ever since the 2020 repeal. You can still be pursued by collectors, and you can still be suspended for other reasons like points or skipping a required clinic.
I am in college out of state and DMV ordered a clinic. What now?
Ask DMV for an extension. Students and service members outside Virginia may get one if no approved clinic is offered where they are.
