Defensive Driving in Louisiana: Tickets and Insurance Savings

Limited use

This page is for a Louisiana driver with a fresh ticket who is wondering whether a class can help, and for anyone hoping to cut insurance costs. The decision you face depends on your parish. No law in Louisiana says a defensive driving class makes a ticket disappear. What many parishes offer is a deal through the district attorney, known as traffic pretrial diversion, which converts a moving violation into a non-moving one; a driving school is often part of the price, and each parish writes its own terms. Insurance is a separate track: a state approved defensive driving course can earn as much as 10 percent off.

Step by step

  1. Find out who prosecutes your ticket

Your citation names the court, whether city, parish or district, and that tells you which prosecutor's office owns the case. That office decides whether diversion exists for you.

  2. Request diversion early

File the enrollment request ahead of the court date. Expect a lag, since the police agency may take weeks to forward the ticket.

  3. Wait for acceptance before any class

Hold off on any class until you have the DA's written acceptance. Self-chosen classes have no effect on the case.

  4. Finish every requirement

Fee, school, amended fine: all three by the deadline. Drop any one and you are kicked out and owe the original fine.

  5. Go after the insurance credit separately

Pick an NSC course or a state approved one on your own initiative, then mail the certificate to your insurer.

First, the honest answer about dismissal

A class alone will not make a Louisiana ticket go away. OMV publishes no program that dismisses tickets or clears record entries after a defensive driving course. Any relief comes from local prosecutors and judges, and every office sets its own terms.

The usual one is traffic pretrial diversion. In exchange for a fee and an approved driving class, the prosecutor rewrites the charge so it is no longer a moving violation. Your ticket is resolved, not erased, and the outcome depends on your parish.

What diversion looks like: the Caddo Parish example

Caddo Parish shows the typical shape. After approval you pay $110 to the DA's office (not refundable), complete a driving school from the approved list, and then pay the Sheriff's Office a $219 fine for the non-moving charge. The charge then becomes a non-moving violation that will not show on your driving record for insurance purposes.

You have 25 business days from enrollment to complete it. Do not expect it to be cheaper: the office says the new fine can match or exceed the old one. Fall short on any term and you are dropped from the program and billed the original fine.

To put numbers on it: a Caddo driver accepted into diversion pays $110 plus $219, or $329, and keeps the moving violation off the record insurers see.

  • Excluded: 15 mph or more over the limit
  • Excluded: a DWI conviction within 3 years
  • Excluded: a pending felony in Caddo District Court
  • Excluded: multiple violations within 2 years
  • Excluded: CDL holders

If your ticket is in city court

City courts strike deals too. In Baton Rouge, a standing order of the City Court covers amended tickets: once a charge is reduced to non-moving, you owe that fine plus court costs, absent a judge's different order. Deals worked out with the City Prosecutor can often be wrapped up without going before the judge.

The same Baton Rouge schedule sends school zone speeders to an advanced training school. Ask your city court clerk how amendments work there and whether a driving school is required.

Timing: do not wait until the last week

Diversion requests usually have to be in before the court date on your citation, and in Caddo, the DA reports that a ticket can take as long as a month to reach the office. Build that lag into your plan.

Ignoring the ticket altogether gets your license suspended by OMV. To reinstate after a Louisiana court reports a no-show or nonpayment, you pay $100 and prove the case is closed, for instance with a receipt or the final disposition.

Before you pay: paying is pleading

Sending in the fine has the same effect as admitting guilt, and OMV receives the conviction. The officer's agency determines whether a city, parish or district court has your case, and payment options differ among them. No amount printed on the ticket, or ticket misplaced? Phone that court's clerk.

Contesting means entering a not guilty plea by your appearance date; a trial date follows. Hire counsel or argue it yourself. Lose, and the conviction is reported just as if you had paid. Simply not showing up lets the court alert OMV, and your license stays suspended until the case is resolved and you pay the reinstatement fee, $100 as of October 2026.

After a clean stretch: the 10 percent insurance credit

Subsection (A)(1) of La. R.S. 22:1457 lets an insurer trim liability and physical damage premiums by as much as 10 percent, if its numbers support it. The person insured, who must also be the principal operator, qualifies at any age by completing either the NSC Defensive Driving Course or a course the state public safety and corrections department has approved and certified.

A car with multiple regular drivers gets the reduction only after every one of them has finished a course. State insurance regulators, in an advisory letter (2017-02) last reissued October 18, 2023, direct insurers to treat the course certificate as sufficient proof.

When the credit does not apply

Classes you were ordered or sentenced to take do not qualify. Because a diversion class can fall into that category, so ask your insurer before expecting both benefits from one class.

The law also leaves out experience-rated and assigned risk policies, policies carrying a substandard risk surcharge, and policies already discounted for an approved driver education course.

If you hold a CDL

Commercial drivers are shut out. The Caddo DA cites Louisiana law in excluding CDL holders from diversion, and the federal rule at 49 CFR 384.226 prohibits states from hiding a commercial driver's traffic conviction, whatever vehicle was involved; only parking, weight and equipment defect violations are exempt.

With a commercial license, assume the conviction will post, and think about asking a lawyer whether to contest the ticket.

Points and your record

Nowhere in the OMV material we checked is there a point system, or a course that earns point credit. The thing insurers notice is a moving violation conviction on your record, and that is exactly what diversion tries to avoid by reducing the charge.

Ordering your official OMV driving record before and after the case lets you confirm what actually got recorded.

Louisiana defensive driving: common questions

Will a defensive driving class get my Louisiana ticket dismissed?

No statewide rule allows it. In parishes with diversion, the DA reduces the charge to a non-moving one once you pay and complete a driving class.

What does diversion cost?

Each parish sets its own price. Caddo charges $110 to enroll and a $219 fine afterward, and warns the new fine will not undercut the original.

Can commercial drivers use diversion?

No. Commercial license holders are excluded, consistent with the federal ban on hiding their convictions.

Will a course lower my Louisiana insurance?

Possibly by as much as 10 percent, whatever your age, after an NSC or state approved defensive driving course.

Is there an age limit on the discount?

None. The catch is that everyone who regularly drives the car has to take a course before that car gets the reduction.

If a judge orders the class, do I get the discount?

No. Ordered or sentenced classes are excluded from the credit.

Should I take the driving school before I hear back from the DA?

No. The Caddo Parish DA tells drivers to wait for written confirmation of acceptance before attending.

Does Louisiana use points?

The OMV pages we reviewed describe no point system and no point credit for courses. Ask OMV how a conviction affects your record.

Is there traffic school in Louisiana?

There is no statewide version. When the Legislative Auditor surveyed district attorneys in 2020, 36 of 42 had traffic diversion programs, frequently with a class requirement, and each set its own terms and prices.

What if I miss my court date?

OMV will suspend you once the court reports it. Reinstating means showing the case is closed and paying $100.

Is paying my ticket the same as pleading guilty?

In effect, yes. The conviction goes to OMV. Ask about diversion before you pay.
