Massachusetts Tickets and Driver Retraining: What to Do Next
Court ordered only
This page is for Massachusetts drivers holding a ticket or an RMV letter. The decision you face is whether to pay or contest, and the first thing to know is that no class will make the ticket go away, because the state has no dismissal course. You get 20 days to pay or ask a clerk-magistrate to hear the case. The one course with real weight is the Driver Retraining Program: the RMV orders it once you reach 3 surchargeable events inside 2 years, and finishing it through the National Safety Council within 90 days is what keeps your license from being suspended.

Step by step
Choose a path inside 20 days
Paying the full amount closes the case and gives up your hearing. Asking for a hearing keeps your options open. Doing nothing adds late and release fees and costs you the hearing.
Give it 10 days, then file
A citation takes around 10 days to land in the RMV system. After that, file your appeal on the RMV website, or fill in Box 2, sign the back and post it along with $25 by check or money order, payable to MassDOT.
Go to the clerk-magistrate hearing
You will get a date by mail; plenty of courts run these over video. Have your photos, records or witnesses ready. The officer might not appear, and the citation alone can be enough evidence.
Pay the RMV if the finding goes against you
Lose, and the civil assessment goes to the RMV within 20 days; the court does not take it. If you believe the magistrate erred, ask about an appeal to a judge.
Keep count of your surchargeable events
Responsible findings and at-fault crashes each land at the Merit Rating Board as one event. When the count hits 3 inside 2 years, look for a suspension notice, followed within 10 days by an NSC packet.
Finish retraining before the notice date
You have 90 days to complete the NSC course or the Massachusetts Driver Retraining Program. NSC tells the RMV you finished, and the suspension never begins.
The first thing to know: no class erases a ticket here
In some states you can trade a course for a dismissal. Massachusetts never set that up. No program wipes out a civil motor vehicle citation or keeps it off your record. The only way to a not responsible finding is a hearing, first in front of a clerk-magistrate and then before a judge if you appeal.
Nor can the magistrate knock it down to a warning. RMV hearing guidance reserves that power for the officer who issued the citation. A course you buy online before the hearing will not change the result.
Days 1 to 20: paying or asking for a hearing
Paying in full ends the matter and gives up the hearing. Ignoring the ticket is the worst option: you lose the hearing, late and release charges are added, a default letter arrives from the RMV, and 30 days after that letter an unpaid ticket becomes a license suspension.
Contesting means waiting roughly 10 days for the citation to reach the RMV, then filing online or by post with the $25 court fee. You get that $25 back, usually inside 90 days, when the citation is dated after September 22, 2017 and you win on every violation it lists.
Paying works online with the citation number and offense date, by phone through the RMV Contact Center, or by post: mark Box 1, sign the back, and mail your check or money order (payable to MassDOT) to Citation Processing Center, P.O. Box 55890, Boston, MA 02205-5890. Never put cash in the envelope.
Hearing day: how it runs
A clerk-magistrate, or an assistant, runs the session without the formal rules of evidence. The officer is not obliged to come; a police representative may read from the ticket or a report. You give your account and can hand over photos and documents or call witnesses.
For civil charges the test is whether it is more likely than not that you did each one. If you lose, the assessment is due at the RMV in 20 days, and you should ask for extra time before the session ends if you need it. Missing the hearing without good cause leaves you owing the full ticket within 20 days of the date it was set for.
After a responsible finding: surcharges and what speeding costs
The state keeps no classic tally of license points. Each violation and at-fault crash becomes a surchargeable incident on file with the Merit Rating Board, which shares it with insurers. In Safe Driver Insurance Plan terms, the incident is worth 2 surcharge points for a minor violation, 5 for a major one, 3 for a minor at-fault crash and 4 for a major at-fault crash.
Not every insurer uses the SDIP; some run their own plan. Where the SDIP applies, clean driving pays off three ways: your first minor violation that is not criminal in a five year span carries zero points, the Clean in 3 rule trims each incident by a point, and five or six years without incidents earn Excellent Driver Discounts.
A worked speeding example: caught at 60 where the limit is 40, you are 20 over. Start at $50, add $10 for each of the 10 mph past the first 10 over (that is $100), and add the $50 surcharge, for $200 in all. If the stretch was a marked construction zone, state law doubles it.
- Major violation: 5 points
- Major crash where you were at fault: 4 points
- Minor crash where you were at fault: 3 points
- Minor violation: 2 points
When the RMV letter arrives: the Driver Retraining Program
Chapter 175, Section 113B requires the RMV to send a suspension notice when your count reaches 3 surchargeable events in a 2 year window, with violations from other states included. Ninety days from that notice is your deadline to complete either the National Safety Council course or the Massachusetts Driver Retraining Program, and NSC posts you an information packet within 10 days.
Done before the date printed on the notice? The RMV takes no further action. Late? Your license, or right to operate, stays suspended until the course is complete. The law makes this suspension mandatory, it allows no hardship license, and one more event down the line can trigger another required course.
If it gets worse: suspensions with no course option
Get found responsible for three speeding tickets inside any 12 months and Chapter 90, Section 20 imposes a mandatory 30 days off the road. Reach seven surchargeable events across 3 years and a 60 day suspension begins 30 days after the notice. A hardship license is not available for either.
Then there is habitual traffic offender status: a 4 year suspension for 3 major moving violations, or 12 moving violations of any mix of major and minor, inside 5 years. At-fault crashes are left out of that count. This one, unusually, can qualify for a hardship license when you meet the conditions.
For parents: courses tied to a junior operator's suspension
Under-18 drivers have their own required classes. A second passenger or curfew breach, or a first speeding offense, means a Driver Attitudinal Retraining Course. A speeding or drag racing finding adds the State Courts Against Road Rage program, which a junior operator completes only once.
The RMV publishes its approved attitudinal courses; one is Alive at 25, a 4 hour National Safety Council class for drivers aged 16 to 24. Finishing one is a condition for getting the license back. It does not cut the suspension short, and the suspension still runs after the 18th birthday.
Before you buy a class: what will not count
A class you choose for yourself cannot dismiss a ticket, delete a surchargeable event, or answer an RMV retraining notice, unless it is the very program that notice names. Rely on the packet from the National Safety Council, and contact NSC yourself if it never arrives.
We found no official Massachusetts rule obliging insurers to lower premiums for a mature driver or voluntary defensive driving class. Ask your carrier before paying for one on that hope alone.
Special cases: criminal citations and CDL holders
A few tickets carry criminal charges rather than civil ones, for instance operating to endanger or driving while suspended. The 20 day process does not apply. Chapter 90C, Section 3 gives you 4 days to request a hearing, in writing, from the district court clerk-magistrate, who then decides whether a criminal complaint should issue. Skip that and a summons follows.
Holders of a commercial driver's license have a federal duty under 49 CFR 383.31: tell your employer in writing within 30 days after any traffic conviction except parking, whatever vehicle you were driving. That includes a responsible finding in your personal car, and no class removes the obligation.
Massachusetts defensive driving: common questions
Is there a class I can take to get a Massachusetts ticket dismissed?
No such class exists here. Within 20 days, pay the ticket or request a hearing before a clerk-magistrate.
What is my deadline to contest a ticket?
Twenty days. Give the citation about 10 days to reach the RMV, then file online or by post along with the $25 filing fee.
What counts as a surchargeable event?
Either a violation you were found responsible for or a crash where you were at fault. Each one goes to the Merit Rating Board, insurers see it, and three inside two years mean a required retraining course.
How long do I have to finish Driver Retraining?
Ninety days, counted from the RMV's suspension notice. Complete the NSC course or the Massachusetts Driver Retraining Program by the notice date and you are never suspended.
Will a defensive driving course lower my surcharge points?
No. Courses do not touch surchargeable events. Under the SDIP, points fade as time passes: Clean in 3 can cut them, and the sixth and oldest year of the review period carries none.
What happens after three speeding tickets in one year?
Three responsible findings for speeding in any 12 months, counting tickets from other states, means 30 days without a license. No hardship license is offered.
Will I get the $25 hearing fee back if I win?
You will if you paid it, the citation postdates September 22, 2017, and every violation on it was found not responsible. The refund takes about 90 days.
How do I work out what a speeding ticket will cost?
Begin with $50, add $10 for each mph above 10 over the limit, and add the $50 surcharge. A marked construction zone doubles the fine.
My ticket lists a criminal charge. What now?
Within 4 days, send a written hearing request to the district court clerk-magistrate. You cannot settle a criminal citation by paying the RMV.
As a CDL holder, do I have to tell my employer about a ticket in my own car?
Yes. Federal rules give you 30 days to notify your employer in writing of any non-parking traffic conviction, in any vehicle.
Can the magistrate turn my ticket into a warning?
No. That decision belongs only to the officer who issued the ticket.
