Illinois Traffic School: Using Court Supervision on a Ticket

Can dismiss a ticket

This page is for Illinois drivers holding a ticket and hoping traffic school can keep it off their record. It can, but only through court supervision, and the decision you face is whether to ask for it before you pay. For many minor offenses, a judge, or in designated counties a written plea under Supreme Court Rule 529, can put you on supervision with a court-approved traffic safety program as a condition. Finish on time and no conviction reaches your Secretary of State record. Miss a condition and supervision is revoked and a conviction entered.

Step by step

  1. Read what the ticket allows

The citation and the circuit clerk tell you whether you can handle it by mail or must appear. Offenses listed in Supreme Court Rule 551 always need a court date.

  2. Ask for supervision before you pay

In counties the Conference of Chief Circuit Judges has designated, a local rule may allow supervision on a written guilty plea plus the Schedule 12 assessment. Everywhere else, ask the judge on your court date.

  3. Use only the court's program

Take the class your circuit has approved, not one you pick. In Cook County that means the National Safety Council, which will place you in either its 4 hour or 8 hour session.

  4. Pay the court and the school separately

The Schedule 12 assessment or fine goes to the circuit clerk; any program fee goes to the provider. Cook County will not take a credit card for mailed payments, only a check or money order.

  5. Make sure the certificate is filed

A provider may file it for you, but Rule 529 makes it your job to see it filed before supervision ends. If it is late, supervision is revoked automatically and a conviction is entered.

  6. Stay out of trouble during supervision

In Cook County supervision lasts four months; with no new violation reported, the case is dismissed. A new violation can bring a hearing and any sentence the original offense allowed.

First, how traffic school works in Illinois

Supervision defers judgment. If you meet the conditions, such as paying and finishing the program, the case is dismissed rather than turning into a conviction. The Cook County court notes this outcome is available for most traffic violations that carry only a fine.

The circuit clerk still reports supervision to the Secretary of State. Cook County's court says those reports are confidential, used only by courts, police and the Secretary of State, cannot be the basis for a suspension or revocation, and are not released to insurers.

If your county allows it: supervision by mail

Many small tickets can be handled entirely on paper under Supreme Court Rule 529: mail in a guilty plea with the Schedule 12 assessment. The exceptions are offenses Rule 551 says need a court appearance. Some counties, chosen by the Conference of Chief Circuit Judges, go a step further and let a local rule or order add supervision to the mailed plea.

Where that exists, you typically promise to complete a safety class after paying, and you cover the class fee yourself. Not every county takes part, so the option depends on where the ticket was written.

If you are under 21

For anyone under 21, supervision on a moving violation, a GDL breach or a serious traffic offense comes with strings under 730 ILCS 5/5-6-1: pay the fine and costs, and agree to sit and pass the court's traffic safety class. Young drivers do not get supervision without the class.

Some offenses rule young drivers out entirely. Cook County's examples include reckless driving, going more than 26 mph over, passing a school bus while children are getting off, leaving the scene of a crash and driving with no valid license; each one disqualifies the driver from supervision and from both courses.

Teens under 18 must come to court in person, and a parent or guardian must give written consent there, unless the judge excuses it.

If you have used supervision recently, or the offense is serious

Certain tickets cannot be supervised at all. Cook County's examples include work zone or school zone speeding that put workers or children at risk, going around a school bus while kids are getting on, and a repeat charge for driving uninsured or showing bogus insurance.

Some limits apply in every county. Under 730 ILCS 5/5-6-1(k), a driver who already had supervision two times in the year before this stop cannot get it for a new moving violation. That statute also rules it out when the speed was 26 or more over in an urban area, and on any second aggravated speeding charge.

If you hold a CDL or commercial learner permit, Cook County's ban is only half of it. Federal rule 49 CFR 384.226 stops every state from hiding, deferring or diverting your traffic convictions, even in your own car (parking, weight and equipment defect cases aside). In practice, supervision will not keep a commercial driver's ticket off the record.

  • Supervised twice in the last 12 months: no third time, anywhere in the state
  • Caught at 26+ over the limit in an urban area: no supervision
  • CDL and CLP holders: federal law bars masking the conviction
  • Rule 551 offenses: must go to court; no written plea

Choosing the course: length, format and fees

Courts choose their own classes, so how long and in what format depends on the circuit. In Cook County the National Safety Council teaches two: a short 4 hour defensive driving class and a full 8 hour one, each available in Polish, Spanish or English. Expect to pay $20 extra for the longer class.

In Cook County, a driver 21 or older qualifies for the 4 hour course if not enrolled now and not enrolled in the last 12 months. Before signing up anywhere, ask your circuit clerk or the approved provider whether an online version counts in your county.

If convictions pile up: suspension and points

625 ILCS 5/6-206 lets the Secretary of State suspend or revoke a driver convicted of 3 or more moving violations within any 12 months. It cannot act on that basis more than six months after the last conviction.

Whether the state acts, and for how long, comes down to points. For an adult with three convictions in a year and no recent suspension, 92 Ill. Adm. Code 1040.30 means nothing happens below 15 points, two months off the road from 15 through 44, and steadily longer terms after that, ending in revocation at 110. Supervision is not a conviction, so it carries no points and is not one of the three.

Younger drivers get less room. Under 625 ILCS 5/6-206(a)(36), two convictions inside two years can be enough, and a one month suspension starts at just 10 points. See our Illinois point reduction page for what typical tickets are worth.

Worked example: an adult with two speeding convictions this year gets a third ticket. Paying it means a third conviction and a possible suspension. Asking for supervision with traffic school keeps the count at two.

If you just want an insurance discount

Illinois law, as far as could be confirmed, does not make insurers give a discount for a defensive driving course you take voluntarily, at any age. Your insurer can tell you which courses, if any, it rewards.

Supervision itself is the bigger insurance win: Cook County's court says supervision results cannot be released to insurers.

Paying, fighting or missing the court date

The ticket tells you whether mail is an option or you must show up. Careful: just paying, without a supervision request, means pleading guilty, and that becomes a scored conviction. In counties that allow it, Rule 529 lets you include a written supervision request with your payment.

Think you are innocent? File a not guilty plea with the circuit clerk before the ticket's date and you will get a trial. Whatever you do, do not miss the date. Skipping it can lead to a failure to appear suspension, and getting reinstated afterward costs $70 under the Secretary of State's fees.

What will not work

Buying a defensive driving class online on your own does nothing for an Illinois ticket. The only class that counts is the one your circuit court approved, taken because the court ordered it as part of supervision.

Supervision does nothing for offenses that bar it, and it does not override the separate teen rules: a conviction on the permit still delays the license nine months, and one in the first license year extends the passenger limit.

Illinois defensive driving: common questions

Can traffic school keep an Illinois ticket off my record?

Yes, but only as part of court supervision. Finish the court's class and other terms, and the case is dropped rather than entered as a conviction.

Is supervision the same as a conviction?

No. It puts judgment on hold, and if you follow the terms, the case is dismissed. In Cook County the court adds that supervision cannot be grounds for a suspension and is kept from insurers.

How often can I get supervision?

No more than twice in any one year. A third request within 12 months of the earlier two is refused, in every county.

Must a driver under 21 take traffic school?

To get supervision, yes. 730 ILCS 5/5-6-1 allows it for moving violations only if the young driver agrees to complete a court-approved program.

Can a CDL holder use traffic school?

Not in Cook County, which bars commercial license holders whatever they were driving. Elsewhere, ask the court and consider a lawyer, since federal law forbids masking CDL convictions.

How many tickets lead to a suspension?

The Secretary of State may act after 3 moving violation convictions in 12 months. Supervision is not a conviction.

How long is traffic school?

That varies by county. In Cook County, the National Safety Council puts you in a 4 hour or an 8 hour class.

What if I never finish the course?

The court revokes supervision and records a conviction if proof of completion has not been filed by the end date, per Rule 529.

Can a class help after I'm suspended?

Sometimes. Adults whose suspension is three months or shorter, and was caused by three moving violations within a year, can become eligible for a probationary license by completing an 8 hour defensive driving class. The Secretary of State's Special License and Re-Examination Unit handles it: 217-782-2720.

How long does a ticket stay on my record?

An ordinary speeding conviction shows for about four to five years. One that helped cause a suspension stays for seven years or more after you are reinstated.

Should I just pay the ticket online?

Read the ticket first. A payment with no supervision request counts as pleading guilty, and you end up with a scored conviction.
