Understanding California DMV Points and Negligent Operator Rules

This page is for California drivers who want to know where they stand after a ticket or two, and for parents of new drivers. The decision is usually what to do about the next ticket, because points already on your record cannot be removed. A typical moving violation costs one point here. The heavy offenses, reckless driving, DUI and hit and run, cost two. Collect four within a year, six within two years or eight within three, and the DMV labels you a negligent operator. Traffic school's only power is to keep one qualifying new ticket confidential.

Step by step

  1. Get your record

The DMV sells you an unofficial online printout for $2; the official version costs $5 and is requested on form INF 1125. Add up the points, paying attention to the date each violation happened.

  2. Ask about traffic school for any new ticket

A new single point infraction, with no traffic school used during the last year and a half, is worth raising with the court, since completion keeps that point out of your total.

  3. Read every DMV letter closely

Warning letters and notices of intent each correspond to a level, so they show exactly how close you are. Copy any hearing deadline onto your calendar.

  4. Ask for a hearing if a suspension is coming

The law lets you contest a proposed suspension at a hearing and bring evidence about your driving history. The request window is short: ten days if the notice was handed to you, fourteen if it was mailed.

  5. Keep a clean record while points age out

Each point stops counting once it is older than the look back period being applied. Picking up another violation while on probation, however, adds more suspension time.

Start here: what each ticket is worth

Under section 12810 of the Vehicle Code, the everyday safety violations, speeding for example or driving a car in unsafe condition, carry a single point. Two points go with the offenses the code treats as grave, such as DUI or leaving the scene. A few mechanical problems carry none at all; the DMV cites an unlit rear plate as one.

A crash can cost you as well. When police decide you caused it, the DMV may assign a point, usually one, for that at fault collision. Tickets you got in other states can also land in your California count.

If you drive for a living: commercial points

Commercial driving multiplies the cost. Behind the wheel of anything that requires a Class A or B license, or that calls for certain certificates or endorsements, each conviction is weighted at 150 percent. So the one point speeding ticket in a family sedan becomes a one and a half point ticket in a big rig.

At a hearing, Class A and B holders may ask for a more generous ceiling, measured at six points over one year, eight over two years and ten over three. That option disappears for people holding particular certificates (school bus, ambulance and hazardous materials are examples) and for anyone already over the ordinary Class C limits.

As points build: the four NOTS levels

NOTS, short for the Negligent Operator Treatment System, works like a staircase. The first step is a letter of warning, triggered by two points inside one year, four inside two, or six inside three. Step two, the notice saying the DMV intends to suspend, comes with three points in one year, five in two, or seven in three.

Step three is no longer a warning. Four points in a single year, six across two or eight across three bring an order: twelve months of probation, half of which is a suspension, starting 34 days from the date the order goes in the mail. Step four kicks in if you violate probation or a suspension, fail to appear, or fail to pay, and it adds a further six months of suspension. A third such violation costs you the license for a year through revocation.

Picture a driver with a 1 point speeding ticket in March, a 1 point at fault collision in August and a 1 point red light ticket the following January. That is 3 points within 12 months, which is the notice of intent step. One more point inside that window reaches the order.

  • Step one: warning letter
  • Step two: the DMV announces it intends to suspend
  • Step three: twelve months of probation, including six suspended
  • Step four: added suspension, then revocation

If you are the parent of a provisional driver

Teen drivers on a provisional license are not measured against adult point totals. The DMV counts tickets and crashes they caused instead. During the license's first year, any pair of them earns a month of driving only with a licensed adult who is 25 or older. A third earns half a year of suspension and then twelve months on probation.

Birthdays change nothing here. A restriction, suspension or probation that started at 17 keeps running after 18, and any drug or alcohol conviction picked up from age 15 through 20 means either a year's suspension or a postponed license.

If you want points gone: what is and is not possible

California has no class that erases points you already have. Per the handbook, crashes and convictions remain visible for at least 36 months, longer for some types, and the look back windows just keep moving forward with the calendar.

Your only lever is preventing the next point. Using traffic violator school on a qualifying single point ticket, at most once per 18 months, keeps that conviction confidential. Drivers 55 and up can also take the eight hour Mature Driver Improvement course, which may lower insurance premiums but does nothing to points.

If you missed a court date or cannot pay

A skipped court date carries real weight. Your license can be suspended by the DMV until you show up, the no show is entered on your record, and for someone already on probation it can push the case to step four.

If paying is the obstacle, use MyCitations to request a review of what you can afford, and do it before the ticket is due rather than letting it go delinquent.

California defensive driving: common questions

What does a speeding ticket add to a California record?

Normally one point. In a vehicle that requires a Class A or B license, it counts as one and a half.

How long do California points stay?

Most entries remain 36 months, and certain serious ones longer. The suspension rules look back over one, two and three years.

When does the DMV send a warning letter?

Once you reach two points in a year, four in two years, or six in three years.

Is there a class that removes California points?

No. Traffic school can shield one qualifying new ticket; earlier points are untouched.

How can I see my point total?

Pull the unofficial version online for $2, or mail or bring form INF 1125 to an office for the $5 official copy.

What happens when I hit 4 points in a year?

The DMV can order twelve months of probation that includes a six month suspension. Ask for a hearing before the order takes effect.

How long do I have to request a hearing?

Ten days when the notice is served on you in person; fourteen when it arrives by mail.
